FMCSA on ELDs: Longtime ‘government supervision’ of trucking justifies privacy intrusion
Relative to ELDs potential to infringe on truckers’ privacy, FMCSA argues that’s simply part of being a truck driver. Trucking has a “‘long tradition of close government supervision,’” the agency says, citing a 1987 court decision. Truckers should have a lower expectation of privacy while on the job because of it, FMCSA’s lawyers argue in their court brief.

Supreme Court rejects trucker’s request to intervene in ELD lawsuit
The U.S. Supreme Court has denied a trucker’s formal request to intervene in the lawsuit brought against the U.S. DOT’s electronic logging device mandate, siding with a lower court that also barred the trucker from intervening in the case.

FMCSA gets two extra weeks to issue response to ELD court challenge
FMCSA must now issue its response by June 15. The plaintiffs in the case, which includes the Owner-Operator Independent Drivers Association and truckers Mark Elrod and Richard Pingel, under the new schedule now have until June 29 to file a court response to the agency’s brief.
